editorial on the Michael Sandy MURDER: my comments/ questions on the article: "when is a hate crime not a hate crime" from NYmag.com

I met Michael Sandy when i was living in New York, he was close with a group of boys i knew (and still know very well) that all went to F.I.T. (fashion institute of technology, or fags in training, which ever makes you more comfortable). On a very personal and sad note, this article from NYmag.com: When Is a Hate Crime Not a Hate Crime? discusses the Michael Sandy murder from last year (Oct. 2006) and questions if the validity of this particular hate crime.

NYmag.com writes that, "everything changed in court in September, when the lawyer for the alleged ringleader, Anthony Fortunato, announced in his opening statement that his client couldn’t be guilty of a gay hate crime because he, too, was secretly gay." WHAT? when did secretly being gay mean you can get away with murder?


"Was Anthony Fortunato really gay, or was this just a ploy to undermine the D.A.’s case?"
Honestly, does anyone really care if he was "really gay" or kinda gay, a little gay, had a gay thought once, saw a gay porn and kinda liked it... etc.?


" If he was telling the truth, is a gay man even capable of committing a gay hate crime?"
This must be comedy. I don't think i can even respond to this question... anyone want to respond for me?


"And what, at the end of the day, is a hate crime, anyway?"
This is a valid question that obviously needs to be addressed. From my opinion, "hate" is what defines a "hate crime". If "being gay" or "not being gay" defined a "hate" crime, then it might be called a "gay or not gay crime".


AND WHAT THE @#$% is this all about:
"(Race was never a serious factor in the case, despite the fact that the victim was black and the alleged perpetrators were white.)" Yeah. I'm SURE.

grrr. GRRRRRRRR.

That's ridiculous. Hopefully, the court sees through his "coming out" defense. If anything this argument should strengthen the case against him since it makes sense for a closeted gay man to hate gays
